This User Agreement (hereinafter referred to as the "Agreement") is an official offer (public offer) of Individual Entrepreneur Svetlana Shamilyevna Ramaeva (hereinafter referred to as the "Contractor") to any individual (hereinafter referred to as the "User") who accepts this offer on the terms set forth below.
In accordance with Article 437 of the Civil Code of the Russian Federation (CC RF), this document is a public offer, and in the event of acceptance of the terms set forth below, the individual performing the acceptance of this offer shall make payment for the Contractor's Services in accordance with the terms of this Agreement. In accordance with paragraph 3 of Article 438 of the Civil Code of the Russian Federation, payment for the Services by the User constitutes acceptance of the offer, which is considered equivalent to concluding a Contract on the terms set forth in the offer.
Please read the text of this Agreement carefully. Use of the website Sanatanadharma.world and its services, including registration, subscription, or purchase of individual products, signifies your full and unconditional agreement with the terms set forth in this Agreement.
1. Terms and Definitions
- Site – a collection of information, texts, graphic elements, design, images, photo and video materials, and other results of intellectual activity, as well as computer programs contained in the information system that ensures the availability of such information on the Internet at the network address: https://sanatanadharma.world/.
- User – a legally capable individual who has reached the age of 18 and has accepted this offer by registering on the Site and/or paying for the Services.
- Contractor – IE Ramaeva Svetlana Shamilyevna, providing Services to the User under the terms of this Agreement.
- Services – providing the User with access to digital products and services of the Site, including:
- One-time purchase: providing perpetual access to individual units of content (book, lecture) in electronic form.
- Subscription: providing access to a specific library of Content or services for a limited period (e.g., 1 month) with the condition of automatic renewal (autopayment).
- Recurrent Payment (Autopayment) – automatic deduction of funds from the User's bank card to pay for the Subscription renewal without the need for re-entering card details and confirming the operation.
- Content – all objects posted on the Site, including texts, audio recordings, video lectures, images, and other materials that are objects of the Contractor's intellectual property.
- Personal Account – the User's personal section on the Site, access to which is carried out using a unique login and password.
2. Subject of the Agreement
2.1. The Contractor undertakes to provide the User with Services for providing access to the Content of the Site in accordance with the purchase selected and paid for by the User, and the User undertakes to pay for these Services and comply with the terms of this Agreement.
2.2. The terms, cost, and content of the Services (individual books) are published on the relevant pages of the Site.
3. Procedure for Provision and Payment of Services
3.1. To gain access to paid Services, the User must complete the registration procedure on the Site and create a Personal Account.
3.2. Payment for Services is made by the User through the "YooKassa" payment service in accordance with the rules of this service. All issues related to the payment procedure are resolved by the User directly with the representatives of the payment service.
3.3. One-time purchase:
3.3.1. When purchasing an individual product (book), the User makes a 100% prepayment of its cost.
3.3.2. Access to the purchased Content is provided to the User in the Personal Account after confirmation of the fact of payment.
3.4. Subscription Registration (Recurrent Payments):
3.4.1. By paying for the Subscription for the first time, the User gives the Contractor and the "YooKassa" or "Stripe" payment service unconditional consent for regular automatic deduction of funds (subscription fee) from the User's bank card in the amount of the cost of the selected tariff.
3.4.2. Deductions are made automatically on the day of expiration of the paid period (e.g., every month). Entering a CVC code or an SMS code for renewal is not required.
3.4.3. The Subscription is valid indefinitely until it is canceled by the User.
3.5. Cancellation of Subscription:
3.5.1. The User has the right to refuse to renew the Subscription at any time. To do this, it is necessary to click the "Cancel Subscription" button in the Personal Account settings on the Site.
3.5.2. Cancellation of the Subscription terminates future charges. Access to the Content is maintained until the end of the already paid period.
3.6. Refund Policy:
3.6.1. No refund is made for an already paid Subscription period, even if the User did not use the Content, as the Service is considered rendered at the moment of providing access (granting the right to use).
3.6.2. If the User forgot to cancel the Subscription and funds were deducted, no refund is made. The responsibility to monitor the subscription status lies with the User.
3.7. The Contractor is considered to have fulfilled its obligations from the moment of providing the User with access to the paid Content in the Personal Account.
3.8. In accordance with the legislation of the Russian Federation, no refund is made for services of proper quality already rendered (i.e., after providing access to digital content).
4. Rights and Obligations of the Parties
4.1. The Contractor undertakes to:
4.1.1. Provide the User with access to the paid Services in accordance with the terms of this Agreement.
4.1.2. Ensure the confidentiality of the User's personal data in accordance with the Privacy and Personal Data Processing Policy, which is an integral part of this Agreement.
4.1.3. Inform the User about changes in the terms of this Agreement by publishing a new edition on the Site.
4.2. The Contractor has the right to:
4.2.1. Unilaterally change the cost of Services and the terms of this Agreement by publishing relevant changes on the Site. The new terms do not apply to the period already paid for by the User.
4.2.2. Block the User's access to the Personal Account and Services in case of violation of the terms of this Agreement without a refund of the funds paid.
4.3. The User undertakes to:
4.3.1. Provide accurate information when registering on the Site.
4.3.2. Pay for the Contractor's Services in full and on time.
4.3.3. Not transfer their login and password for the Personal Account to third parties.
4.3.4. Use the Content of the Site solely for personal, non-commercial purposes.
4.4. The User is prohibited from:
4.4.1. Copying, distributing, publicly reproducing, processing, or using the Content of the Site in any other way for commercial purposes without the prior written consent of the Contractor.
4.4.2. Attempting to gain unauthorized access to the functions of the Site and the Personal Accounts of other users.
5. Intellectual Property
5.1. All Content posted on the Site is the object of intellectual property of the Contractor and is protected by the legislation of the Russian Federation.
5.2. The User is granted a non-exclusive right (simple license) to use the Content by viewing and listening solely for personal use without the right to copy and distribute.
6. Collection and Processing of Personal Data
6.1. Upon registration and payment for Services, the User provides the Contractor with their personal data (name, email address, payment details, etc.).
6.2. By accepting this offer, the User:
Gives their consent to the collection, storage, and processing of their personal data by the Contractor for the purpose of executing this Agreement.
Expresses unconditional consent to the cross-border transfer of their personal data to the territory of the Federal Republic of Germany (servers of the hosting provider Hetzner Online GmbH) to ensure the operation of the Site and the provision of Services. The User is notified that Germany provides adequate protection for the rights of personal data subjects.
6.3. The procedure for the collection, storage, and processing of personal data is regulated by the Privacy and Personal Data Processing Policy posted on the Site.
7. Liability and Dispute Resolution
7.1. The Contractor is not liable for the impossibility of providing Services for reasons beyond its control (technical failures of providers, communication problems, etc.).
7.2. All information and materials provided on the Site are of an informational and educational nature. The Contractor is not liable for how the User will use the information received.
7.3. All disputes and disagreements that may arise from this Agreement shall be resolved by the parties through negotiations.
7.4. In case of impossibility to resolve disputes through negotiations, they are subject to consideration in a court at the location of the Contractor in accordance with the current legislation of the Russian Federation.
8. Term of the Agreement and Final Provisions
8.1. This Agreement enters into force from the moment of its acceptance by the User and remains in effect until the parties have fully fulfilled their obligations.
8.2. The Contractor has the right to make changes to this Agreement at any time unilaterally. The User is obliged to independently monitor the current version of the document.
8.3. On all issues not regulated by this Agreement, the parties are guided by the current legislation of the Russian Federation.
